Deprivation of Liberty Safeguards represents the legislative framework and administrative process that provides authorisation for adults that lack capacity to be deprived of their liberty when being accommodated for either their care or treatment. This course alongside three others allows you the opportunity to develop the underpinning skills, knowledge and values to prepare for the Best Interest Assessor (BIA) role. They are also aimed at enabling you to develop an ethical understanding of what it is to promote and safeguard the well-being of adults who lack mental capacity. On completion of this course and the three others that make up the suite, you will be in a strong position to train as a BIA on the course offered by the University and your prior learning will be recognised. Together the suite of unaccredited courses are very useful for teams of support workers in contact centres responsible for triaging referrals and signposting to relevant support services other than social care. Additionally, they can also be useful in supporting the role of Complex Discharge Facilitators in both mental health and general nursing, thereby supporting speedy or planned discharge. The increased knowledge gained from the suite of course, can potentially boost confidence thereby avoiding delays in communication and discharge. This course provides a solid introduction to the Mental Capacity Act along with other relevant legislation such as Human Rights Act 1998 and Mental Health Act 1983 as amended by the 2007 Act. The course will the focus on the specifics of a Mental Capacity Assessment in relation to following the principles and good practice. Additionally, the course will look at how to weigh-up and assess information obtained from a Mental Capacity with a view to making defensible decisions regarding a service user or patient. The course will then continue by looking at what constitutes the ‘best interests’ of a patient/service user and the importance of advocacy. On completion of this course and the three others that make up the suite, you will be in a strong position to train as a BIA on the course offered by the University and your prior learning will be recognised.

Additionally, practitioners also need the necessary skills and knowledge to balance human rights alongside safeguarding. This course will enable you to identify what constitutes risk and then focus on risk assessment strategies that are available, along with considering a checklist for good practice in relation to best interests and deprivation of liberty.
